''I was on my way home, I went to the lobby main entrance of the Shangri-la Hotel to page my driver. While I was waiting inside the hotel lobby Mr. Lockie suddenly approached me and poked his face in front of my face and told me the following words to wit:
'''Mr. Silvino, where is your mother? You and your mother are finished, f--ck you. I'll make sure you're finished.'''
''And then he told me to go outside with him for a fight, and he said these words twice. I told him: 'If you want to settle this, I will call security.'
He started walking outside the hotel. I shouted for help and hotel security responded.
''I boarded my car and went home and I informed my mother about the threat made by Mr. Lockie to both of us. Then we went to the precinct near the hotel.''
2) Excerpts from the counter-affidavit of Darren Lockie, as filed at the Metropolitan Trial Court of Makati on Feb. 4, 2000:
''On Nov. 16, at around 8:30 p.m., I was going down the stairs of the Makati Shangri-La Hotel leading to the main lobby. On my way out, Victor Silvino was on my path and I met the latter by chance at the main lobby of the hotel.
''Expressing disgust on what I perceived as unprofessionalism of both Silvino and his mother, I remarked to him: 'Victor, what you and your mother tried to do to me in the past was unprofessional and I'm glad you failed in getting me deported. I'm still here. I can tell you now that I will not give you reason to get me deported.'''
''Victor Silvino then angrily retorted: 'If I can't get you deported, I'm going to kill you. This time you're dead.'''
''I then replied to Victor Silvino that 'We could always go outside now and settle this like real men.'''
''Victor Silvino responded that he was calling security and scurried toward the front reception desk.''
''I turned and casually walked out of the Shangri-La Hotel via the front door to go home. As I walked down the driveway toward Glorietta Mall, Victor Silvino came running out of the Shangri-La lobby and screamed at the top of his voice: 'I will kill you. You're dead, you're dead, you're dead.'''
''To avoid any further untoward incident and fearing for my life, I left the hotel and went home.''
