Batasan blast suspect appeals for bail

MANILA, Philippines—One of the primary suspects in the deadly explosion at the House of Representatives in 2007, who remains at large, filed a motion to "fix bail" before a Quezon City court hearing the case.

Benjamin "Jang'' Hataman filed his petition, dated November 26, 2008, through his lawyer Norlito Eneran at the continuation of the hearing by Regional Trial Court Branch 83 Judge Ralph Lee, Wednesday morning.

Hataman asked the court to "fix the amount of bail" and allow him to "put up bail for his temporary liberty.''

Hataman, in his motion, cited laws that allowed persons to post bail for offenses lighter than those punishable with reclusion perpetua, especially if the evidence were not strong.

He said the evidence presented against him so far was "not strong."

"The evidence was fabricated, baseless, malicious and were done under duress based on the recantation on the two affidavits issued by his co-accused, Ikmar Indama,'' the motion said.

A source in the court said the judge could only act on the motion after the filing of a comment by the Department of Justice.

The source also said that another hearing on the case has been scheduled for December 10.

Indama, in the initial stage of the investigation told police, that Hataman was the one who detonated the bomb that killed Basilan Representative Wahab Akbar and four others on November 13, 2007.

But Benjamin Hataman, through his lawyer, noted that Indama had executed affidavits on October 6 and November 8, clearing Hataman.

Hataman with several others including former Basilan Representative Gerry Salapuddin and his brother, Anak Mindanao Party list Representative Mujiv Hataman, were among those charged with multiple murder and multiple frustrated murder by the police.

The police earlier said Salapuddin and the Hataman brothers masterminded the blast targeting Akbar.
