MANILA, Philippines—The Court of Appeals has designated a justice who will handle the petition of Chief State Prosecutor Jovencito Zuno questioning the three months suspension imposed on him by the Presidential Anti-Graft Commission (PAGC).

During Wednesday’s raffle, appeals court second division's Associate Justice Portia Alino-Hormachuelos will handle the case together with Associate Justices Noel Tijam and Sesinando Villon.

The appeals court acted on Zuno's petition after the Supreme Court refused to issue a temporary restraining order on Zuno's suspension, instead remanded the case to the appeals court.

The high court, in its one page resolution, said Zuno should have followed the hierarchy of courts instead of going straight to the high tribunal.

PAGC last May 29 suspended Zuno for 90 days for refusal to prosecute Jorge Joseph, Richard Brodett and Joseph Tecson, also known as the “Alabang Boys,” for violation of the Dangerous Drugs Act.
