Comelec: No proclamation yet for BH Party-list amid DQ case dismissal

The Commission on Elections (Comelec) on Friday said that the Bagong Henerasyon (BH) will not yet be proclaimed even after the dismissal of its disqualification case.

MANILA, Philippines — The Commission on Elections (Comelec) on Friday said that the Bagong Henerasyon (BH) Party-list will not be proclaimed yet even after the dismissal of its disqualification case.

According to Comelec Chairman George Erwin Garcia, the poll body is waiting for the response of the petitioner on the decision.

“The division still has not yet ordered a proclamation because we will wait for the remedy of the petitioner now that the case against the respondent was dismissed,” Garcia told reporters in Filipino during an interview.

“There will still be no proclamation in favor of the BH Party-list,” Garcia added in Filipino.

The Comelec suspended its proclamation, along with the Duterte Youth Party-list, amid the pending case. A disqualification case was filed against the party-list due to allegations of abuse of state resources.

The Comelec First Division dismissed the disqualification petition as the petitioner did not submit an affidavit as to why the copy of the petition was not served to the respondent personally. The petitioner also failed to attach the Certificate of Nomination and Certificate of Acceptance of Nomination, which also became grounds to junk the petition.

Meanwhile, Garcia explained that the petitioner can file their motion for reconsideration for the case or can refile their petition.

“Five days after the petitioner received the decision, and the petitioner earlier received it, the Comelec’s decision will be final and executory and therefore, the National Board of Canvassers will order the proclamation of the party-list, along with its nominee,” Garcia answered in Filipino when asked of the Comelec’s move if the petitioner will not make any remedy to the case.

Garcia shared that if the party-list will be proclaimed, it may be held at the Session Hall of the Comelec main office in Intramuros, Manila. The proclamation of the party-lists was held last May 19 at the Manila Hotel Tent City.

Based on the official and final votes, the BH Party-list ranked 39th in the party-list race, amassing 5.92% of the total votes or 319,803. /jpv
