Marcy Teodoro to be proclaimed once Comelec’s order becomes final

MANILA, Philippines — Marcelino “Marcy” Teodoro will not yet be proclaimed as the winner of the Marikina City 1st District congressional race in the 2025 midterm elections unless the ruling of the Commission on Elections (Comelec) en banc becomes final and executory.
This is what Comelec Chairman George Erwin Garcia told reporters on Thursday when asked if Teodoro can now be proclaimed after the Comelec en banc lifted the order to suspend his proclamation.
Garcia said that the order to lift the suspension order is included in the decision to reverse the Comelec First Division’s cancellation of his certificate of candidacy (COC) due to alleged material misrepresentation of his address.

“Makakasama [ito] sa limang araw na hihintayin upang ang desisyon ng Comelec en banc ay maging final and executory,” Garcia told reporters in an interview.
“This is included in the five days before the Comelec en banc’s decision becomes final and executory,” Garcia told reporters in an interview.
“Because the decision was released yesterday, this has not yet been implemented. We will wait for five days before the Comelec’s decision becomes executory,” he added.
Garcia noted that the city board of canvassers (CBOCs), composed of the local Comelec official, city prosecutor, and the Department of Education superintendent, will conduct the proclamation. Garcia also said that the CBOC is an independent body that will determine when the proclamation will happen.
“Kung magcoconvene ngayon, pagkatapos ay magpoproclaim ay mukhang magiging ilegal po yun base sa hindi pa final ang desisyon ng komisyon,” he said.
“If the CBOCs convene now and proclaim [Teodoro], this will be illegal since the commission’s decision is not yet final,” Garcia said.
Meanwhile, Garcia maintained that the poll body will comply with the Supreme Court if it issues a temporary restraining order.
He said those who did not get a favorable Comelec decision could go to the high court and ask for a temporary remedy.

Teodoro won the congressional race against outgoing Sen. Koko Pimentel in the May mid-term polls, garnering 75,062 votes against Pimentel’s 29,091. Teodoro’s proclamation, however, was suspended due to pending cases before the poll body.
Pimentel and a certain Leighrich Estanislao, in their consolidated petitions seeking to cancel Teodoro’s COC, claimed that the outgoing Marikina City mayor was not a resident of Barangay San Roque in the 1st District of Marikina as he just transferred from Barangay Tumana in the 2nd District before the start of the filing of COC.
However, the Comelec en banc said that it found that the petitioners failed to prove that Teodoro committed material misrepresentation in his COC./coa
