Comelec decision on Marcy Teodoro case now final, executory

MANILA, Philippines — The Commission on Elections (Comelec) has issued a certificate of finality and entry of judgment to proclaim Marcelino “Marcy” Teodoro as the duly elected representative of Marikina City’s 1st District in the 2025 elections.
This follows the Comelec en banc’s decision lifting the order suspending his proclamation and reversing the cancellation of his certificate of candidacy (COC), which has now become final and executory.
In a two-page order dated July 1, the Comelec released the certificate of finality and entry of judgment on its en banc ruling issued on June 25, 2025.
“[T]he Resolution of the Commission (En Banc) promulgated on 25 June 2025 is hereby declared IMMEDIATELY EXECUTORY under the COMELEC Rules of Procedure, and COMELEC Resolution No. 11046,” the order reads.

The poll body noted that the Supreme Court did not issue a restraining order within five days of both parties receiving the Comelec resolution, allowing the decision to become final and executory.
In a previous interview, Comelec Chairman George Erwin Garcia said Teodoro could be proclaimed the rightful winner once the Comelec en banc ruling took effect.
He also clarified that the order lifting the suspension of his proclamation was included in the decision to reverse the cancellation of his certificate of candidacy.
“This is included in the five days before the Comelec en banc’s decision becomes final and executory,” he explained.
Teodoro won the congressional race against former Senator Koko Pimentel in the May 2025 elections, securing 75,062 votes against Pimentel’s 29,091. However, Teodoro’s proclamation was suspended due to pending cases before the poll body.

In their consolidated petitions seeking to cancel Teodoro’s COC, Pimentel and a certain Leighrich Estanislao claimed that the outgoing Marikina City mayor was not a resident of Barangay San Roque in the 1st District, arguing he had only recently transferred from Barangay Tumana in the 2nd District before the start of the COC filing period.
However, the Comelec en banc ruled that the petitioners failed to prove Teodoro committed material misrepresentation in his COC.
The en banc noted that Teodoro did not make any material misrepresentation regarding his voter registration, as he marked the option “I will be a registered voter of…” and listed his address in Barangay San Roque.
It explained that the “phrasing reflects a future-oriented, contingent status that is conditional upon the expected approval of his pending application.”
The Election Registration Board approved Teodoro’s voter transfer on October 18, 2024, 13 days after he filed his COC.
The en banc also stated that Teodoro’s previous declaration of residence in Barangay Tumana does not establish a change in domicile, or permanent address. It added that Teodoro “is not a stranger or newcomer” to the 1st District, as it is his domicile of origin./mcm
